LIMITED WARRANTY:
Our products will be free from defects in material and manufacture. If this product is defective, your exclusive remedy shall be, at our option, replacement of the product or refund of the purchase price within 30 days of the original purchase date.
LIMITATION OF LIABILITY:
PADTAB WILL NOT BE LIABLE FOR ANY DIRECT, CONSEQUENTIAL, INDIRECT, INCIDENTAL, PUNITIVE OR SPECIAL DAMAGES OF ANY KIND WHETHER ARISING IN CONTRACT OR TORT INCLUDING BUT NOT LIMITED TO THE LOSS OF DATA OR INFORMATION, IN CONNECTION WITH THIS AGREEMENT, THE SITE, OR ANY PADTAB PRODUCT. OUR AGGREGATE LIABILITY ARISING OUT OF THIS AGREEMENT, THE SITE, OR ANY PRODUCT SHALL NOT EXCEED THE LESSER OF THIRTY US DOLLARS OR THE AMOUNT YOU HAVE PAID TO US.
THE PADTAB IS SOLD ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. IN NO EVENT WILL PADTAB OR ANY PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING, OR DISTRIBUTING PADTAB BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS , LOSS OF DATA OR INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PADTAB, THIS WEBSITE OR OUT OF THE BREACH OF ANY WARRANTY. THE CUSTOMER HEREBY ACKNOWLEDGES BY ACCEPTING THE TERMS OF SALE THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL SALES AND/OR USAGE OF THIS WEBSITE.
INDEMNIFICATION
Customer agrees to indemnify and hold PADTAB, its members, managers, employees, officers, and agents harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debts, and expenses (including but not limited to attorney's fees) arising from Customer’s use of this Website or from Customer’s violation of this Agreement or any third party's rights including but not limited to copyright, property, and privacy rights. This indemnification and hold harmless obligation will survive any sale and/or Customer’s use of this Website.

Customer agrees not to upload, post, or otherwise make available on this Website any material protected by copyright, trademark, or other proprietary rights, without the express permission of the owner of the copyright, trademark, or other proprietary right. PRIVACY
Personal data provided by Customer to PADTAB will be used only in connection with services provided on this Website and will not be given to unaffiliated third parties except as required by law. While PADTAB will seek to require third-party content providers and other parties to adhere to PADTAB’S privacy policies, PADTAB does not bear any responsibility for any actions or policies of such third parties.
MISCELLANEOUS
The Terms of Sale and any operating rules for this Website established by PADTAB constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import. This Agreement is made under, and shall be construed in accordance with, the laws of the State of Ohio. Any disputes arising from or relating to this Agreement or any default in any terms and conditions thereof shall be resolved by binding arbitration in Franklin County, Ohio pursuant to the then-applicable rules of the American Arbitration Association, provided however, that PADTAB may seek specific enforcement and injunctive relief with respect to Customer’s breach of copyright or trademark or other intellectual property protections contained herein. In such event, Customer hereby agrees to the jurisdiction and venue of the state and federal courts sitting in Franklin County, Ohio (USA), as the courts of proper and exclusive subject matter and personal jurisdiction and venue of and for any and all actions and proceedings relating to the Terms of Sale and use of this Website; hereby irrevocably consent to such designation, jurisdiction and venue; hereby waive any objections or defenses relating to jurisdiction or venue with respect to any action or proceeding initiated in any of said courts.
CAUTION!
Removing PadTab components that have been adhered to a product, device, wall or surface may cause damage if removed improperly. Use of the PadTab is entirely at your own risk. Under no circumstances, including, but not limited to, negligence, shall PadTab be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use, the PadTab product.
Installing the TabClip to the surface:
1. Clean and thoroughly dry surface area.
2. Use a level to ensure even alignment of the tab on the surface.
3. Remove tape backing and firmly apply tab to the surface.
Note: The TabClip and PadTab can be used immediately after installation; however, it may take up to 72 hours for the adhesive to fully bond and any small air bubbles to be released. Please do not leave the PadTab docked for an extended period of time. There is no simple formula to calculate the exact time due to many unknown factors like weight, temperature, humidity and most importantly the unknown surface its used on. We recommend as a rule of thumb to allow the adhesive to "rest" once every 24 hours for 10-15 minutes by "undocking" the PadTab to allow the tabs to re-bond itself back to the surface from static load creep.
REMOVAL:
The PadTab uses an industrial strength acrylic bonding adhesive, and may cause damage if removed improperly. If you must remove the PadTab or TabClip, use a hairdryer for 30 seconds in a circular motion to heat the adhesive then twist tab slowly. DO NOT PULL STRAIGHT OFF! YOU MAY DAMAGE THE SURFACE! You can optionally use a piece of dental floss, held tautly between two hands. Slide floss between the tablet and PadTab (or Surface and Tab), and by pulling back and forth, split the tape, and release the mounted object. Remove the remaining material on both surfaces with thumbnail and rolling motion. Not recommended for use on wall paper and delicate surfaces.
Although we've tested with 5 lbs as an extreme case, The average supported weight is 2 lbs indoors under normal room temperature on a clean, smooth and dry surface. Most tablet devices should be under 2 lbs (The iPad weighs 1.6 lbs for example).
